1 REPORTER'S NOTE: JAMES M. MACNISH, JR., District Judge, was
appointed to hear case No. 63,896 vice Justice Abbott pursuant to
the authority vested in the Supreme Court by Article 3, Γ§ 6(f) of
the Kansas Constitution. The opinion of the court was delivered by We have reviewed and considered the briefs, the arguments, and
the record in this case. We conclude the unanimous panel of the
Court of Appeals was correct. We therefore adopt the opinion of
the Court of Appeals, Read v. Miller, 14 Kan. App. 2d 274,
788 P.2d 883 (1990), reversing the trial court.
